Pennsylvania personal injury law puts the burden on the injury victim
If you have been injured by the negligence of another, you may be entitled to recover compensation for your present and future medical expenses, lost income and diminished earning capacity, pain and suffering, emotional distress and other legally recognized personal injury damages. However, the law places the burden on you to recover that compensation from the negligent party. This means you must be able to prove that the other party was negligent (that they breached a duty of care they owed to you), and that their negligence caused your injuries. You must also be able to prove the nature and extent of your injuries, including how those injuries may impact your life in the future.
